General sales conditions

BOOKING

Your booking implies your agreement to the general conditions and is equal to a reservation in the case that a place is available. The booking form must be signed and dated.

For travel that includes a flight: the booking form must be precisely completed with the first names and last names exactly as they appear on your passport.  If your first names and your last names have to be changed there will be a charge:

- before ticket issue,120€.

- after ticket issue, the price of a new ticket.

Deposit payment

The booking will be accompanied by a deposit of 30% that is based on the price of the trip and the insurance purchased.
We will notify you once we have received the deposit by email or by post.
Note: we reserve the right to not accept a participant that does not fulfill the requirements necessary for the level of the group.

Billing

As soon as the deposit is received, we send you a bill.
The first time you book with us you will be charged a 15€ booking fee. A final bill is issued:
- 17 days before the departure for land-only travel.
- 27 days before the departure for a travel that includes a flight
The bill will itemise the balance (egs flight taxes, extra for small groups). 

Balance payment

For land-only travel:

the balance has to be settled, without a reminder from us, 15 days before your departure.
In the case that you sign up within 21 days of departure, the total of the price is to be paid directly by bank card, upon reserving your place.
All late balance payments may be classed as a cancellation, for which cancellation fees will be charged.

Balance payment for a trip including a flight

The balance must be settled at the latest, without a reminder from our part: 31 days before your depart abroad.
In the case that you sign up within 31 days of your departure abroad or 21 days within France, the total of the price is to be paid upon booking, by bank card.
All late balance payments may be classed as a cancellation, for which cancellation fees will be charged.

Last minute booking

- For land-only travel, a last minute enrolment is defined as an enrolment less than 8 days before departure. You will be charged an extra 5€ administration fee.

- For a travel that includes a flight, a last minute enrolment is defined as an enrolment less than 31 days before boarding. You will be charged an extra 10€ administration fee, in addition to any higher airfare price.
In such a case, we ask that you to pay in cash or with your credit card.

Amendments to your tour arrangements

Administration fees:

- If you want to go sooner or to leave later than the group: 50€, in addition to any higher airfare price.
- If you want to change your airline: 50€, in addition to any extras (airfare, transfers, accommodation).
- If you want to rent equipment: 3€
- If you want accommodation the day before departure: 5€

CANCELLATION

If you cancel your participation

Notify us as soon as possible by letter.

General scale travel without a flight:

- 31 days or more before your departure: we keep 50€ per person.
- from 30 to 21 days before the departure: 30%
- from 20 to 15 days before the departure: 60%
- at less than 15 days: 100% of the total cost of your trip

General scale travel including a flight:

- 60 days or more before your departure: we keep 150€ per person.
- 60 to 31 days before departure: 25%
- 30 to 21 days before departure: 50%
- 20 to 15 days before departure: 75%
- less than 14 days before departure: 100% of the total cost of your trip

If you cancel more than 31 days before your departure, we will reimburse you, except for administration costs and the insurance premium. The cancellation insurance contract does not intervene. Less than 31 days before your departure we will reimburse you except for cancellation fees according to the scale above. If you have signed an insurance contract, the cancellation fees will be taken into account after your file has been accepted. Insurance refunds will not start until you have paid in total the sum that you owe. If you do not pay what you owe, we will block the process and you will lose the sum you have already paid.

Specific scale:

The cancellation fees could be increased if the fees in your name are greater then those of the general scale (for example: a plane ticket). In this case, the specific cancellation conditions of the carrier will be listed on your bill.

One way flights : Each carrier has their own specific cancellation conditions which prevail over ours.

If you interrupt your course or trip

If you have signed a contract, the insurance will proceed with refunds according to the contract conditions. All voluntary interruptions from your part do not qualify for any reimbursements. No reimbursements can be made for having an inadequate fitness and/or skill level and its effects on the safety of the group.

If we interrupt a course or trip

If the trip (land-only) is interrupted, for any reason, you will receive a non-transferable voucher valid until December 31 of the following year for all the services not used. No refund, no indemnities will be granted.

There are enough people, but we can’t do the trip

1/ If adverse political or health circumstances arise, or administrative authorisation is withheld, you’ll be told as soon as it occurs.

-> We will change the location for another route or for another summit with the same level of difficulty. The price of the trip could change (we will try to keep it in the same range). The only refusal accepted on your part will be your prior ascent of the summit substitute. In this case you will be refunded, without indemnities. No other reason will be accepted and the cancellation will be your own choice. Cancellation fees will apply.
-> If it’s not possible to organise another trip substitute, we will postpone the departure. You’ll receive a non-transferable voucher valid until December 31 of the following year, for all the services not used. No refund, no indemnities will be granted.

2/ If the weather is bad, you’ll be told 2 days before your departure.

-> For trips with flights, except in the case of force majeure, the departure will be confirmed.
-> For land-only trips, we will change the location. The price of the trip could change (we will try to stay within the same range). The only refusal accepted will be your prior completion of the substitute trip. In this case, you will be refunded, without indemnities. No other reason will be accepted and the cancellation will be your own choice and cancellation fees will apply. If bad weather affects all the Alps, we will postpone departure. You will provide us with your availibility. You will receive a non-transferable voucher valid until December 31 of the following year for all the services not used. No refund, no indemnities will be granted.
 
... because not enough people booked

Either the trip goes ahead, with a supplementary price unanimously accepted by all the participants; or we will offer to transfer your booking to another organisation that offers a similar program; or we will reimburse you all monies paid, without keeping any compensation.
You will be warned at the latest:

    - 7 days before the departure of a weekend trip.
    - 15 days before the departure of trips taking place in another country in Europe
    - 21 day before the departure of trips outside Europe

INSURANCE

For you*, we have negotiated with APRIL, a contract with a choice of 2 options:

- All Riks : Rapatriation + medical expenses + search and rescue + cancelation + lugage + civil responsability

- Cancelation : Cancelation + lugage + civil liability

In the case where you do not wish to take All Risks Insurance, we request that you decline the insurance and let us know on the insurance form the contact details of your own insurer.
Please ensure you read the application, exclusions and terms of each guarantee in the general conditions of the contract, available by asking Odyssée Montagne for a copy.

CIVIL LIABILITY

In accordance with the law, we are insured under professional civil responsibility of a travel agency: HISCOX - 12 quai des Queyries - 33100 Bordeaux. This does not substitute for individual civil liability, which each participant must have.

LIABILITY

Odyssée Montagne does not assume the individual liability of the client whose responsibility it is to inform themselves of all the police, health authorities’ and customs’ formalities before the departure and throughout the trip. No refunds will be made for if you are late for your departure, due to negligence on your part that leads to the impossibility of your departure. Those of another nationality must inform themselves of the administrative and health formalities according to the relevant embassy.

Odyssée Montagne is an intermediary between the client and the services provided (transport, hotels, expedition guides). It is not to be confused with the services who in all states conserve their own right of responsibility. The carrier is notably responsible for damages, theft or late luggage. In the case of an incident it is to them that you will have to make a claim.

The consequences of accidents or incidents occurring during air transport fall under the dispositions of the convention of Varsovie or by the local regulation concerning the transports according to the law of the country concerned. We can only be held responsible for the timetable or itinerary modifications, of notification if there is a need to change airports due to exterior events, such as strikes, technical incidents, airline changes, severe weather. The consequent delay will not lead to any compensation. The ensuing fees (taxi, hotel, parking, train ticket) will be at your own charge.
For your intermediate transport, be sure to plan a minimum connection time of 3 hours with modifiable or exchangeable tickets.

AMENDMENTS

As the nature of our trips is very particular, modifications to the programs can occur depending on the level of the participants’ skills, the mountain conditions, the technical requirements as well as other factors. The extras has to be paid by yourself and won’t be refunded.
For your security, the guide will be the only judge of any changes made to the program. If the trek must be interrupted and it is not possible to replace it with another program, (a decision made unanimously by the participants), you will have the choice, valid until December 31 of the following year, of any trip offered in our catalogue, which is equal to the unused credit. No reimbursements will be made.

NOTIFICATION

Airlines reserve the right to modify the timetable without warning. In this case, we will inform you immediately. The hours are indicated in local time.

PRICE

The prices mentioned consist of, except when specifically mentioned on the technical forms, the guide’s services, accommodation, meals, transport, and other means of transport during the stay (air transport, cable cars, taxi, bus). Not included are: transport to the meeting point, insurance, drinks, snacks. For trips outside Europe, the prices are defined by the class of reservation. When this class is full, we will offer you either another reservation class, or another flight. The price difference will be billed to you as extra charges.
The prices will be defined by the number of participants (technical forms). An extra “small group” charge may be billed to you 21 days before your departure, depending on the number of participants.
In accordance with the law, all changes to the USD exchange rate, of the costs of the transport (petrol), boarding taxes, park entry taxes and ascent permits could lead to price reviews. We will inform you 21 days before your departure. If you refuse to pay the new price, it will be considered as a cancellation and a cancellation fee will be applied.

DISPUTE

All complaints should be addressed to Odyssée Montagne, by a registered letter, at the latest 20 days following the return date, with justifying documentation. All disputes can result in a hearing at the Bonneville commercial court.

 

NO SOLICITATION

The customer agrees not to contact the guide that was previously submitted by Odyssey Mountain, in order to form a services contract without going through Odyssey Mountain, which would then be entitled to ask for compensation based on the damage suffered.
The present clause will be worth even if the solicitation is an initiative of the guide.
